Defence witness Dragan Tomic said he was present when "his friend from the same village" was wounded in his right shoulder-blade on May 5, 1992.
"In 1992 village patrols were organized in Malesici because no army was present there as yet. On that day five of us heard some shooting coming from the Kozluk area, so we went there to see what was going on. When we arrived we saw Josic, who had been wounded in his right shoulder-blade "by a bullet". He was wounded and
covered with blood," the witness said.
Tomic says that after being wounded Krsto Josic went to "Loznica for medical treatment", adding that he lived at his sister's in Trnovica village in that period of time.
"I did not see him in Malesici until the end of the summer. His sister lived in Trnovica village. She looked after him, so he did not come home at the time....at the end of summer of 1992 he was mobilized by some support unit with the Republika Spska Army, VRS," Josic said.
The Prosecution of Bosnia and Herzegovina charges Josic and Ljubo Tomic, former members of the VRS, with having "shot at and killed, using firearms, three Bosniak civilians, while one civilian managed to run away" in Marhosi forest, near Kozluk, in Zvornik Municipality, on June 26, 1992.
The indictment alleges that Bosniaks were deported from Kozluk and that they found shelter in Marhosi forest, which was surrounded by members of the Serb Army.
The Prosecution of Bosnia and Herzegovina considers that the indictees found the remaining Bosniaks, "recognized their neighbours and shot at them, using firearms, with the intention of killing them".
The second Defence witness, Ljubinka Stevanovic, said that, after having been wounded, Josic lived at his sister's in Trnovica village until the end of the summer of 1992. She said he was not capable of living on his own or joining any army at the time.
"My and Ljubinka's husbands are brothers. We have been living in the same house for years. I say that, in May 1992 Josic came to his sister's, after having been wounded. We lived in the same house until the end of the summer of 1992," the witness said, adding that, after having recovered, Josic was mobilized by the Army,
but she did not know where he went afterwards.
The next hearing is due to take place on January 18, 2010, when the Defence of Josic will examine new witnesses.
