Bejtic’s Defence Requests Exemption of Judge

Marija Tausan BIRN BiH Sarajevo
Defence attorney Fahrija Karkin requests the exemption of judge Zorica Gogala, because he considers that she cannot be objective in this case.
“It is known to me that judge Gogala personally survived a tragedy, similar to the one described in this case. This indicates that she would not be objective,” Karkin said.

Ljiljana Filipovic, Chairwoman of the five-member Trial Chamber, said that the Defence’s motion would be submitted to the President of the Supreme Court in order to make a decision regarding the exemption request.

It was planned that a session be held before the Supreme Court in order to discuss a Sarajevo Cantonal Prosecution’s appeal against a verdict pronounced in December 2011, under which Bejtic, former member of the Tenth Mountain Brigade of the Army of Bosnia and Herzegovina, BiH, was acquitted of charges for crimes against Serb civilians at Kazani locality in 1992 and 1993.

Bejtic was extradited from Germany 12 years ago. He has been on trial since. In 2006 he was sentenced to 14 and a half years in prison for crimes at Kazani and acquitted twice afterwards – in 2008 and 2011.
